By visiting, viewing, accessing or otherwise using any of the services or information created, collected, compiled or submitted to Medata you are deemed to have agreed to all the following Terms and Conditions of Sale/Service. Before you use the Website, please read these Terms and Conditions carefully as you agree to be bound by them by the usage of this Website. If you do not accept to these Terms and Conditions, we would strongly suggest you not to continue use of this Website.

Creating an Account

To use certain features of the Website (e.g.uploading your Personal Medical Data (PMR), booking an appointment, posting rating/reviews, receiving, flyers, e-newsletter, etc., you must set up an account with www.medata.in ("Medata Account") and provide information as prompted by the Customer Information form, including, your name, gender, date of birth, email address, mobile phone number and billing/shipping address. All of your registration information is protected by our Privacy Policy.

You represent and warrant that the information you submit during registration is accurate and that you will maintain the accuracy of such information.

Your Medata Account username and password are personal to you. You may not transfer your account and you will be responsible for the activities associated with your Medata Account.

Medata will not be responsible or liable for any loss or damages as a result of your failure to maintain the confidentiality of your account credentials. If you suspect any unauthorised use of your Medata account, you shall immediately notify medata.in It is your responsibility to keep your email address up-to-date on your account setup at www.medata.in so that we can communicate with you electronically.

Privacy Policy

Your personally identifiable information will be used in accordance with our Privacy Policy. To understand our practices, as to how we collect, use and disclose your personally identifiable information, please adhere to our Privacy Policy, which also governs your visit to www.medata.in.

We understand the privacy of all information you provide is of a primary importance. This is why we do everything possible to use it carefully and sensibly. This information is never shared with other companies or third party service providers.

All your data is safe and protected that is provided to Medata when you visit our Website or use our Services by uploading your data on to our Website. Customer eligibility

Our Customers or Users must be over 18 years of age and registered with us. Medata is not intended for children under the age of 18. We will not knowingly collect information from Medata visitors in this age group.

Appointment Booking Facility

Medata allows its Users to book an appointment with Practitioners via two ways:

Medata will ensure Users are provided confirmed appointment on the Book facility. However, Medata has no liability if such an appointment is later cancelled by the Practitioner, or the same Practitioner is not available for appointment.

If a User has utilized the telephonic services, Medata reserves the right to share the information provided by the User with the Practitioner and store such information and/or conversation of the User with the Practitioner, in accordance with our Privacy Policy.

The results of any search Users perform on the Website for Practitioners should not be construed as an endorsement by Medata of any such particular Practitioner. If the User decides to engage with a Practitioner to seek medical services, the User shall be doing so at his/her own risk.

Without prejudice to the generality of the above, Medata is not involved in providing any healthcare or medical advice or diagnosis and hence is not responsible for any interactions between User and the Practitioner. User understands and agrees that Medata will not be liable for:

Users are allowed to provide feedback about their experiences with the Practitioner, however, the User shall ensure that, the same is provided in accordance with applicable law. You however understand that, Medata shall not be obliged to act in such manner as may be required to give effect to the content of Users feedback, such as suggestions for delisting of a particular Practitioner from the Website.

In case the Patient does not show (“No show” or “NS”), implying that where the User does not show-up at the concerned Practitioner’s clinic:

Cancellation and Refund Policy

In the event that, the Practitioner with whom User has booked a pre-paid appointment via the Website, but has not been able to meet the User, User will need to write to us at support@medata.in within five (5) days from the occurrence of such event; in which case, the entire consultation amount as mentioned on the Website will be refunded to the User within the next five (5) to six (6) business days in the original mode of payment done by the User while booking. In case where the User, does not show up (NS) for the appointment booked with a Practitioner, without cancelling the appointment beforehand, the amount will not be refunded, and treated as under Clause ______. However, where cancellation charges have been levied (as charged by the Practitioner/Practice), you would not be entitled to complete refund even if you have cancelled beforehand.

Users will not be entitled for any refunds in cases where, the Practitioner is unable to meet the User at the exact time of the scheduled appointment time and the User is required to wait, irrespective of the fact whether the User is required to wait or choose to not obtain the medical services from the said Practitioner.

Use of Information on the Website

The information provided on the Website or through our services is intended for informational purposes only, and is not intended to diagnose, treat, cure or prevent any disease.

The information on this Website is not a substitute for professional medical advice or treatment for specific medical conditions. However, the Website may become temporarily unavailable due to maintenance, server or other technical issues, or for reasons beyond our control. You agree that any termination of your access to the Website or suspension of your account may be effected without prior notice, and you agree that Medata shall not be liable to you for any such termination. Your right to use the Medata Website/Service immediately ceases upon termination of your access/use of the Website.
